Purpose
To seek approval for the adoption of Primrose Court, Huyton, which is a private road, under the requirements set out under Section 228 of the Highways Act 1980.
Decision
The Executive Director (Regeneration and Economic Development);
- Notes that no objections having been received under section 228 Highways Act 1980 to the Notices displayed in accordance with that provision then Primrose Court has become highway maintainable at the public expense and therefore confirms and authorises the adoption of the road known as Primrose Court, Huyton.
- Authorise that the road can now been recorded as highway maintainable at public expense on the Register maintained pursuant to Section 36(6) of the Highways Act 1980, as indicated on plan number PT/SDT/03323 (Appendix A) and detailed in Appendix B, following the successful completion of the repair works by the Council, pursuant to Section 230 of the Highways Act 1980, and the issue of a Highway Notice served under Section 228 of the Highways Act 1980.
Alternative options considered
Not to carry out the works and adopt this road would leave Primrose Court at risk of further deterioration due to lack of maintenance and this would pose further financial risks to the Council from a small development which has created wider regulatory issues for the authority and local area. This option has been discounted based on the relative risk this would place on the Council, for a potential legal challenge and maintenance costs.
