Purpose
PROPOSED RESIDENTIAL DEVELOPMENT AT MARYVALE,
SKELMERSDALE
Background : West Lancashire Borough Council have resolved to grant
planning permission ref 2023/0809 for a residential development on
land at Maryvale, Skelmersdale. The applicant for the residential
development is Tawd Valley Developments who are an arms length
development company owned by the Borough Council.
The resolution to grant planning permission is subject to the
signing of a section 106 agreement. One of the matters covered by
the proposed agreement is the delivery of affordable housing.
Normally the Borough Council would be responsible for enforcing
such obligations within a section 106 agreement. However, in this
case the borough council and applicant are same body and the
Borough Council in its role as local planning authority therefore
cannot enforce these obligations on itself.
It is therefore proposed that Lancashire County Council will be a
signatory to the section 106 agreement to enable it to enforce the
affordable housing obligations in the event they are not
delivered.
