Purpose

As Executive Director you have responsibility
for both Growth and Regeneration and Statutory Highways
function.
Both functions can hold land.
The development at Farington on land owned by the County Council
involves some land now being given over for highway purposes to
enable works to be done by the highway authority constructing new
highway.
The mechanism by which a local authority, having acquired land for
one purpose, is enabled to use for a different purpose is
appropriation.
The power to Appropriate is found in s122 Local Government Act
1972
Caselaw indicates that Appropriation involves making a properly
considered formal decision which is recorded.
Approval is therefore sought that the land shown coloured pink on
the plan attached be appropriated for highway purpose enabling
works to be carried out by the highway authority to construct new
highway.
