Purpose

This is a decision to make
minor changes to the council's Constitution, to correct an error or
resolve an inconsistency.
 
Budget and Finance Scrutiny
Committee Terms of Reference
 
The terms of reference for the
newly established Budget and Finance Scrutiny Committee have been
finalised in consultation with the Director of Finance and
Commerce, the Director of Law and Governance and the Chair of the
Committee, County Councillor David Shaw. A copy is set out at
Appendix 'A' for approval.
 
Overview and Scrutiny
Committees and Procedural Standing Orders – consequential
amendments
 
Section 2.4 – remove the
reference to Scrutiny Management Board and replace with "The
Council has five Overview and Scrutiny
Committees…"
 
Section 3.5 –
 

Paragraph h) –
remove reference to Scrutiny Management Board and replace with "an
Overview and Scrutiny Committee"
Paragraph z) - remove
reference to Scrutiny Management Board and replace with "Overview
and Scrutiny Committees"

 
Section 4.1 – amend
Committee structure chart to include new Budget and Finance
Scrutiny Committee. The opportunity to reformat the chart has been
taken and the references to the Independent Panel (Employment
Committee) and the Pension Fund Investment Panel have been
removed.
 
Section 6.2 – The Terms
of Reference for the newly established Budget and Finance Scrutiny
Committee has been incorporated.
 
Standing Order C24 –
remove two references to Scrutiny Management Board and replace with
"relevant Overview and Scrutiny Committee".
 
Standing Order C27.3 –
remove the reference to Scrutiny Management Board and replace with
"relevant Overview and Scrutiny Committee".
 

In addition, there is
a reference to Standing Order E2.11 contained in Standing Order
C27.3 which is incorrect. This should be changed to Standing Order
E2, as there is no Standing Order E2.11.

 
Standing Order C28 - remove the
reference to Scrutiny Management Board and replace with "Overview
and Scrutiny Committees".
 
Finance Rules - Paragraph 9.5
– remove the reference to Scrutiny Management Board and
replace with "Overview and Scrutiny Committees".
 
 
Establishment and Appointment
of a Champion for Combatting Sexual Exploitation and Violence
Against Women and Girls – consequential amendments required
following urgent decision taken by the Leader of the County Council
on 30 July 2025
 
Section 5.18 - Champions
– insert new paragraph g) "Champion for Combatting Sexual
Exploitation and Violence Against Women and Girls: To
assist the Leader and appropriate Cabinet Members to tackle sexual
exploitation and violence against women and girls in all its forms,
including coercive control, psychological, mental, emotional,
financial, physical, sexual, cultural and post-separation
abuse."
Members' Allowance Scheme:
Schedule B - Special Responsibility Allowances – amend table
to show 7 champions instead of 6.
 
Additional changes
 
Section 5.24 - Cabinet Member
Portfolios – delete the reference to emergency preparedness
from the Cabinet Member for Rural Affairs, Environment, and
Communities portfolio and retain it within the Cabinet Member for
Resources, HR and Property portfolio. Emergency preparedness
appeared in two cabinet members' portfolios in error. Confirmation
on where emergency preparedness should sit was received from the
Leader of the County Council on 6 August 2025 by email.
 
 
Section 9.23 – Chief
Financial Officer – remove the reference to the Executive
Director of Resources and replace with Director of Finance and
Commerce.
 
Section 9.33 – Proper
Officers – Schedule of Appointments – to amend the
Proper Officer appointed to carry out functions under Sections
115(2), 137(a) and 151 of the Local Government Act 1972 to read the
Director of Finance and Commerce instead of the Executive Director
of Resources.
 
Section 9.33 – Proper
Officers – Schedule of Appointments – to amend the
Proper Officer appointed to carry out functions under Sections 69,
70 and 71 of the Data Protection Act 2018 to read the Information
Governance Manager instead of the Head of Service, Legal,
Governance and Registration.

Proper Officer appointed as the Caldicott Guardian to read the
Executive Director of Adult Services instead of the Head of Service
Learning Disability and Autism.

Director of Adult Services and to amend paragraphs a), g) –

to amend the row labelled, Reserved to the Executive Director of
Resources to read Reserved to the Director of Finance and Commerce
and to amend rows 9 to 13 to reflect this change.

to remove the entry for a Chair of the Lancashire County
Developments Limited to receive a Special Responsibility Allowance.
