Purpose

Approval is sought for the County Council to enter into an agreement for an obligation on the developer to pay a sum of £86,000, broken down into the following: -

•£50,000 payable towards improvements to the A6 corridor including the M55 junction 1.

•£30,000 payable towards the costs of improvements to the Guild Wheel Cycle Path.

•£6,000 payable towards the costs of the provision by the County Council of travel plan support.

Preston City Council's Planning Committee have resolved to refuse the application, one of the reasons being insufficient information in order to make a full assessment of the traffic impacts of the proposed development. This application is now the subject of an appeal.

These figures listed above were agreed with the appellant in the Statement of Common Ground.

Authority to take this decision has been delegated under the Scheme of Delegation to Heads of Service.

It is recommended that the Director of Law and Governance is authorised to enter into an agreement under Section 106 of the Town & Country Planning Act 1990 in connection with the proposed development, providing for obligations on the owner or developer of the land to pay a sum of £86,000.
