Purpose

Approval is sought for the County Council to enter into an agreement under Section 106 of the Town and Country Planning Act 1990, for an obligation for the developer to pay a sum of £20,000 for Community Transport Contribution, £10,000 for Cycle Parking Contribution, £275,000 for Public Rights of Way Contribution, £250,000 for Public Transport Contribution, £45,000 for Traffic Monitoring Contribution and £12,000 for Travel Plan Contribution.

When consulted by Chorley Borough Council for on a planning application for aresidential development of up to 350 homes and a community hub with associated habitat creation, landscaping, open space, parking, footpaths/cycleways, drainage and other infrastructure at Camelot Theme Park Park Hall Road Charnock Richard Chorley, the County Council responded requesting that the developer should be required to contribute monies totalling £612,000.00 for community transport, cycle parking, Public Rights of Way, public transport, traffic monitoring and travel plan

contributions.

The planning application is currently the subject of an appeal and a Section 106 Agreement has been prepared to secure the necessary planning obligations in connection with the proposed development.

Authority to take this decision has been delegated under the Scheme of Delegation to Heads of Service.

It is recommended that the Director of Law and Governance is authorised to enter into an agreement under Section 106 of the Town & Country Planning Act 1990 in connection with the proposed development, providing for obligations on the owner or developer of the land to pay a sum of £612,000.00
