Purpose

Approval is sought for the County Council to enter into a Section 106 Agreement under the Town and Country Planning Act 1990 to secure:

  • A Travel Plan contribution of £10,000.00 to be used by the Local Highway Authority to fund the review of annual Travel Plan reports (produced by the Owner’s appointed Travel Plan Co-ordinator) and to provide guidance on the implementation of the Travel Plan; and
  • A Traffic Regulation Order (TRO) contribution (amount to be confirmed) to cover the cost of implementing any necessary on-street parking controls required as a consequence of the development, to be available for the duration of the Travel Plan (five years).
  • When consulted by Lancaster City Council on planning application 21.01113.FUL/ 25.01118.VCN, the Local Highway Authority recommend approval of the proposed development subject to the above contributions. This is to ensure the development is acceptable in terms of highways and transport.
  • Authority to take this decision has been delegated to the Head of Service – Highways by the Cabinet Member for Highways and Transport.
  • It is recommended that the Director of Corporate Services is authorised to allocate/ spend:
  • £10,000 Travel Plan contribution for the review of annual Travel Plan reports and support for Travel Plan implementation; and
  • A TRO contribution (amount to be confirmed) to fund the provision of any necessary Traffic Regulation Orders and associated on-street parking controls required as a consequence of the development, for the duration of the Travel Plan.
