Purpose

Approval is sought for the County Council to enter into an agreement under Section 106 of the Town and Country Planning Act 1990, for an obligation for the developer to pay the following sums:

• £50,000 towards highways mitigation at M55 J1 Broughton Roundabout

When consulted by Preston City Council for on a planning seeking approval for access only from Broughton Park onto Whittingham Lane (all other matters reserved) for the erection of up to 75no. dwellings, including 60% affordable housing, 40% housing for older people and 15% bungalows, with associated landscaping and public open space at Land South Of Broughton Park (Phase 1), Whittingham Lane, Broughton, Preston, the County Council responded requesting that the developer should be required to contribute monies totalling £50,000.00 for highways mitigation.

The planning application is currently the subject of an appeal and a Section 106 Agreement has been prepared to secure the necessary planning obligations in connection with the proposed development.

Authority to take this decision has been delegated under the Scheme of Delegation to Heads of Service.

It is recommended that the Director of Law and Governance is authorised to enter into an agreement under Section 106 of the Town & Country Planning Act 1990 in connection with the proposed development, providing for obligations on the owner or developer of the land to pay a sum of £50,000.00
