Purpose

Approval is sought for Lancashire County Council to enter into a Deed of Variation relating to planning application 06/2023/0198 at Land to the north of Hoyles Lane and east of Sidgreaves Lane, Preston.

The Deed of Variation relates to a Section 73 application and does not amend or affect the highway obligations secured under the original Section 106 Agreement dated 27 June 2022, including the East West Link Road Contribution payable to Lancashire County Council. The Deed ensures that the obligations contained within the original Section 106 Agreement continue to apply to the development.

It is recommended that the Director of Law and Governance is authorised to enter into a Deed of Variation under Sections 106 and 106A of the Town and Country Planning Act 1990 in connection with planning application 06/2023/0198

John Davies, Head of Highways Network Management, has taken a decision to approve the Section 106 Agreement for Planning Application 06/2023/0198  Hoyles Lane and to the east of Sidgreaves Lane.
