Purpose
The s106 for the development on
‘Land at Dark Lane, Alrewas’ (Planning reference
13/01175/OUTM), includes an ‘Indoor Sports
Contribution’ for £86,545 ‘To be used for the
provision of indoor sporting facilities at Friary Grange Leisure
Centre, Lichfield’. Crest
Nicholson Ltd paid the Council this on the 14th of February
2024.
In October 2020 Cabinet
selected Stychbrook Park as its preferred site for a new leisure
centre, which signalled the end of the use of Friary Grange Leisure
Centre as a public facility for residents. Due to this, the Section 106 agreement has
been negotiated with developer Crest Nicholson Ltd to enable the
£86,545 could be used towards the development of the new
leisure centre instead of Friary Grange.
The Indoor Sports Contribution
definition in the s106 will be changed from ‘To be used for
the provision of indoor sporting facilities at Friary Grange
Leisure Centre, Lichfield’ to ‘to be used for the
provision of indoor sporting facilities at Friary Grange Leisure
Centre, Lichfield and/or a new Leisure Centre development situated
at Stychbrook Park, Lichfield’.
Crest Nicholson have agreed
through legal discussions to the Deed of Variation; for the full
signing of documents to take place we must pay the legal fees for
Crest Nicholson of £2000 to DAC Beachcroft LLC.
Decision
That £86,545 received from Crest
Nicholson Ltd to Lichfield District Council against an s106
agreement linked to ‘Land at Dark Lane, Alrewas’ is
allocated to the new Leisure Centre development at Stychbrook
Park.
This is following a ‘Deed of
Variation’ to the agreement changing the covenant from
‘To be used for the provision of indoor sporting facilities
at Friary Grange Leisure Centre, Lichfield’ to ‘to be
used for the provision of indoor sporting facilities at Friary
Grange Leisure Centre, Lichfield and/or a new Leisure Centre
development situated at Stychbrook Park, Lichfield’.
The £2000 legal fees for this to be
actioned to be paid from approved budgets.
