Purpose
Approval is sought to extend the current
mineral extraction lease at Market Deeping Farms, West Deeping to
Breedon Trading Limited by a further three years in order for them
to complete the extraction of the full site and undertake the
restoration of the land in line with the planning
obligations.
The current lease expires on 28th August 2025. The operator,
Breedon Trading Limited has requested an extension of the lease for
a period of 3 years.
This will allow 6 months for completion of the mineral extraction
and 2.5 years for the appropriate land restoration. There is no
automatic right of renewal within the existing lease.
Once the extraction and restoration are concluded, the majority of
the land will return to the tenant and an agreed area will be
considered to be part of a nature reserve, hence the requirement to
allow the operator to restore the land. This site will be
considered in conjunction with colleagues in LCC’s
Environment team as part of a potential Biodiversity Net Gain (BNG)
site.
Specialist mineral lawyers would undertake the preparation of
documentation in line with previous arrangements if approval
given.
This lease extension does not include land located to the south of
Stamford Road as highlighted by a star on the plan below at
Appendix 1. Said land does form part of the farm tenancy, but is
not included within any mineral lease.
Decision
To approve the extension of the current
mineral lease for land at West Deeping to Breedon Trading Limited
by a further three years in order to conclude extraction and
undertake restoration.
Alternative options considered
Do nothing – this would create a breach
of planning obligations on the operator to restore the land and
prevent the Council from receiving a valuable income
source.
