Purpose

• Lincolnshire County Council recently
received a request to review the roads around Baston and Langtoft
villages with regards to their usage by Heavy Goods Vehicles,
particularly from the quarries located here.

• Whilst the majority of HGVs are using Cross Road to join the
A1175, investigations have shown that the area would benefit from a
7.5 tonnes weight limit to restrict access to the adjacent villages
of Baston and Langtoft as well as the nearby Meadow Road and New
Road. The roads between Baston and Langtoft villages and King
Street are also included in the proposal to remove them as
potential short cuts from King Street to the A15.

• Therefore, it is proposed to prohibit vehicles over 7.5
tonnes as set out on the plans to the Order.

• The Chief Constable, Baston, Langtoft and Market Deeping
Parish Councils and South Kesteven District Council have been
consulted, along with other local groups/companies.

Decision

THE LINCOLNSHIRE COUNTY COUNCIL in exercise of
their powers under Sections 1(1), 2(4) and 3(2) of the Road Traffic
Regulation Act 1984 (which said Act of 1984 in hereinafter referred
to as “the Act of 1984”) and of all other enabling
powers, and after consultation with the Chief Officer of Police in
accordance with Part III of Schedule 9 to the said Act of 1984,
hereby make the following Order:-

1 This Order shall come into operation on and may be cited as the
Lincolnshire County Council (Baston and Langtoft, Various Roads)
(Prohibition of Heavy Commercial Vehicles) Order 20.

2 (1) In this Order:-

“Heavy Commercial Vehicle” has the same meaning as in
Section 138 of the Act of 1984
“Maximum Gross Weight” has the same meaning as in
Regulation 4 of the Traffic Signs Regulations and General
Directions 2016

(2) Except where otherwise stated, any reference in this Order to a
numbered Article or Schedule is a reference to the Article or
Schedule bearing that number in this Order.

3 Save as provided in Article 4 no person shall, except upon the
direction or with the permission of a police constable in uniform,
cause or permit any heavy commercial vehicle with the maximum gross
weight of which exceeds 7.5 tonnes to enter or proceed on any road
or length of road specified in the Schedule.

4 Nothing in Article 3 shall render it unlawful for a person to
cause or permit any heavy commercial vehicle to enter or proceed on
any road or length of road specified in the Schedule, if the
vehicle is:-

(a) being used for or in connection with the conveyance of persons,
goods or merchandise to or from any premises situated on or
adjacent to that length of road or where access cannot be obtained
to premises on adjoining roads by any other public highway;

(b) being used to proceed to or from any premises on or adjacent to
that length when on the occasion, is to be, or has been garaged,
serviced, or repaired;

(c) being used for the purposes of agriculture on any land adjacent
to that length of road, or for or in connection with the conveyance
or haulage of timber felled upon such land

(d) a vehicle granted special written exemption by Lincolnshire
County Council

(e) in connection with the carrying out on, or on premises situated
on or adjacent to, that length of road of any of the following
operations, namely:

(i) building, industrial or demolition operations;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of that length
of road;

(iv) the laying, erection, alteration or repair in or In land
adjacent to that length of road of any sewer or of any main, pipe
or apparatus for the supply of gas, water or electricity or of any
telecommunications apparatus as defined in the Digital Economy Act
2017;

(f) for Fire Brigade, Police or Ambulance purposes;

(g) in the service of a local authority or water authority in
connection with work being carried out on, or on land adjacent to
that length of road in pursuance of statutory powers or
duties.

5. The County Council is satisfied that for preserving or improving
the amenities of the area by prohibiting or restricting the use of
the road or roads in that area of heavy commercial vehicles, it is
requisite that Section 3(1) of the Act should not apply to this
Order.
