Purpose

Failure to notify of DVLA Points

Decision

On conducting 6 monthly
DVLA checks, it was noticed that the driver had been issued 3 penalty points on
their DVLA licence for exceeding the statutory speed limit on a public road
SP30 on 26/02/2024. Licensing had not been made of this offence.

The driver has apologised
for failing to notify the Licensing department in writing as there were family
health issues at the time.

In regards to the
Licensee failing to inform the Licensing authority of points on their DVLA
licence within 10 days of receiving them, the Licensee should be issued with 6
points in accordance with the Hackney Carriage and Private Hire Policy at point
5.9.1 Penalty Points table part 17. These should remain on the taxi licence for
a rolling 12 months and be backdated to the time the authority was made aware
of the DVLA points being in existence.
