Purpose
To consider approving a short-term contract
extension to the existing Operator's Contract for the Waste
Recovery Park, in line with the ongoing procurement of the new
contract.
Content
1. That the
public and press be excluded from the meeting by virtue of
Paragraph 3 (Information relating to the Financial or Business
Affairs of the Authority) of Part I of Schedule 12A of the Local
Government Act 1972, in order that the meeting consider exempt
Annexes A to F to the report.
2. That the
variation of the contract for the Residual Waste Treatment
Facility, as contained in DoV 6, exempt
Annex A to the report, be progressed.
3. That
approval is granted to extend the contract by six months starting
from 1 April 2026 to 30 September 2026.
4. That
authority be delegated to the Director Environment and Property in
consultation with the Director Law and Governance and Director
Finance and Resource to determine and award any further extension
to the contract, post 30 September 2026, for a further period or
periods not exceeding six months.
5. That the
updated subsidy control position resulting from the proposed
extensions of the contract, as detailed in exempt Annex D, be
approved and noted.
6. That the
financial implications of the extension as detailed in section 4 of
the report be noted and the payment mechanism to be applied to the
contract during the extension period, as detailed in exempt Annex B
of the report, be approved and noted.
7. That in
the event a novation is required, approval is granted for the
Council to accept a novation of the fuel supply agreement, full
details of which are included in exempt Annex E to the report, for
receipt into the facility of waste from West Northamptonshire
Council.
8. That
authority be delegated to the Director Environment and Property, in
consultation with the Cabinet member for Resources and Customer
Experience, the Director of Finance and Resources (s151) and the
Director of Law and Governance (Monitoring Officer)
to:
(a) agree
non-material amendments to finalise the
proposed Deed of Variation (exempt Annex A to the report);
and
(b) agree / enter into
any other necessary formal agreements to effect the decisions contained within this
report.
