The Sub-Committee carefully considered all the evidence
before it, including all the evidence from the applicant and those
who made representations.
There had been concern about the conditions which related
to causing a nuisance to other users of the car park and any
residents who had access through that car park.
The issues surrounding CCTV within the area had been
considered and whether the trader’s vehicle was appropriate
to use in the car park and if a change of vehicle could be
considered to reduce some of the problems being caused in the
location.
The Sub-Committee invited the Licensing Practitioner to
consider whether the area could become subject to CCTV.  The trader had also been invited to consider using
a different vehicle as more appropriate for the space.  Neither of these points, however, were conditions
to the consent.
RESOLVED -

1.         That
application be granted for a period of six months, from 1 April
2024 to 31 September 2024.

2.         That a
formal warning be issued with regard to behaviour with regard to
the following conditions attached to the Street Trading
Consent:

(2)       the consent holder
shall not carry on business on any street as to cause obstruction
to road users or cause obvious danger to people using the
street;

(3)       the consent holder
shall not carry on business from any vehicle or erect or place any
stall or other structure in any street except in the area mentioned
in the consent; and

(15)     the consent holder shall not
cause nuisance or annoyance to persons using the street or to the
occupants of any properties in the vicinity.

3.         That
monthly returns in relation to the disposal of waste cooking oil be
provided to the Environmental Health Officer on reasonable
request.

4.         That if,
in any month, the disposal of waste cooking oil has not been used
this must be confirmed to the Environmental Health Officer by the
trader and these records be checked by Licensing
officers.

5.         If any
of the conditions are breached, the Sub-Committee fully expected
the Licensing Practitioner to act to return the matter to a
hearing.
