Purpose

Reasons for the decision

The DD authority is specific to Lotustame so does not cover
transacting with another company, Bluebelltame Ltd. However, given
that Lotustame Ltd is owned by Bluebelltame Ltd who are the
Freeholder, it is considered that this is a minor deviation from
the terms of the DD and therefore the decision to deal directly
with Bluebelltame Ltd can be appropriately made at officer
level.

The original asbestos management plan provided to MKCC by National
Hotel Services Ltd, completed in 2015 needed to be updated by a
specialist surveyor with a new plan being provided to MKCC this was
not reflected in the DD decision made on 6 August. This is minor
deviation from the DD and can be appropriately decided at officer
level.

Content

1 That a
lease a period of five years, with a two-year break clause is
agreed between MKCC and Bluebelltame Ltd.

2. That, if required because of any delay with the completion of
the lease, a tenancy at will be agreed between MKCC and
Bluebelltame Ltd to enable occupation by homeless households to be
placed at Harben House as soon as practicable.

3. That an Accommodation Services Contract for a period of five
years, with a two-year break clause is agreed between MKCC,
Bluebelltame Ltd and National Hotel Services Ltd.
