Purpose
To consider approving a CPO to purchase the
remaining leasehold properties within Serpentine Court, as part of
the regeneration of the Lakes Estate.
Content
1. That the
ongoing negotiations with the owners of holders of outstanding
leasehold interests to acquire the necessary land at Serpentine
Court, be noted.
2. That, in
the event that purchase by private treaty is not achievable,
authority be delegated to the Director of Law and Governance, in
consultation with the Directors of Environment and Property, and
Finance and Resources, to take all steps necessary to secure the
making and implementation of a Compulsory Purchase Order (CPO)
under Section 226(1)(a) of the Town and Country Planning Act 1990
(as amended) and/or any other enabling statutory provisions deemed
appropriate, in order to acquire the areas of land shown edged red
on the Order Map attached to this report as an Annex
including:
(a) the
publication and service of all statutory notices;
(b) the presentation of
the Council’s case at any public inquiry and courts (if
necessary); and
(c) any other
necessary steps to effect the final acquisition of the CPO
land.
