Purpose

To seek a delegated decision to authorise
making and advertising a Definitive Map Modification Order for the
addition of a public footpath to the Definitive Map and Statement
of Public Rights of Way over land known locally as The Grove,
Jesmond shown on the attached plans at Appendix A1 and A2

Content

The Assistant Director Transport agrees with
the recommendation this report sets out after examining all the
available evidence assessed against the relevant legal tests.
The Assistant Director Transport is
recommended to authorise the Assistant Director Legal to:
Make a Definitive Map Modification Order under
the Wildlife and Countryside Act 1981 to modify the Definitive Map
and Statement by the addition of a public footpath as shown on the
plan at Appendix A1, and that the requisite notice of the making of
an Order be given and advertised.
To thereafter confirm the Order as unopposed,
or in the event of relevant objection(s), to refer the Order to the
Secretary of State for determination.
