It was also agreed that in the event that a
satisfactory section 106 agreement covering the issues raised above
is not received by 31 October 2025 that the application be refused
for its failure to make adequate provision in this regard contrary
to Policy DEL1 of the CSUCP unless an extension of time is agreed
to the satisfaction of the Assistant Director Planning in
consultation with the Chair and Vice Chairs of the Planning
Committee.
iv.
It was also agreed that delegated authority
be given to the Assistant Director Planning in consultation with
the Chair and Vice Chairs of Planning Committee to amend, add or
omit conditions and heads of terms of the section 106 legal
agreement, where appropriate, to ensure the application complies
with relevant development plan policies and national planning
guidance.
