Purpose

To enter into a Section 278 of the Highways
Act 1980 (the Act) Agreement with Taylor Wimpey UK Limited and
Persimmon Homes Limited (being the Developers) in relation to site
access and cycle/pedestrian infrastructure for the Development
known as Kenton Bank Foot Phase 5&6 (the Highway Works).
To dedicate existing grass verge (which is owned by the Council and
held for highway purposes) as Adopted Highway as part of the new
cycle/pedestrian infrastructure.
To authorise use of the procedure set out in Section 228 of the
Highways Act 1980 to formally declare three areas of land as
highway maintainable at the public expense following completion of
the Highway Works.

Content

The Assistant Director of Transport is
recommended to:
Authorise the Assistant Director Legal
Services to enter into a S278 Agreement with the Developers.
Dedicate the NCC owned verge as Adopted
Highway
Follow the procedure in S228 of the Act to
declare three small areas of land of unknown ownership as highway
maintainable at the public expense following completion of the
Highway Works.
