APPLICATION

Committee’s
reasoning and findings are:
This is a hearing of a review application
dated 5th January 2026 for a review of the premises
licence for The County, 1529 Walker Road, Newcastle-upon-Tyne, NE6
3LB. The premises licence holder is Trust Inns Limited. The review is brought under the provisions of S167
Licensing Act 2003 following a Closure Order made by South Tyneside
Magistrates Court on application of Northumbria Police under the
provisions of S80 of the ASBCP 2014.
The effect of the Order was to close the premises on 5th
January 2026 for a period of one month.
At the hearing Trust Inns Limited sought the
disposal of the review by the removal of the DPS and the
modification of the conditions of the premises licence.
Committee were advised that a dialogue had
been entered into by Trust Inns Limited with the Licensing
Authority and Northumbria Police which had resulted in a Schedule
of Conditions being agreed between Trust Inns Limited and
Northumbria Police. The Licensing
Authority were still in disagreement regarding the wording of a
number of those conditions.
Trust Inns Limited did not challenge or
contest the evidence of Northumbria Police or the Licensing
Authority during the hearing. It was
noted that the DPS has been removed from position and that it is a
requirement that an application for the appointment of a
replacement DPS must be made to the Licensing Authority and that
Northumbria Police will be in a position to consider the
application.
Committee took into consideration the concerns
of the Licensing Authority regarding the proposed wording of
Condition 9 and the temporary nature of the requirement for Door
Supervisors. However, Committee were
persuaded that along with a new DPS and a change in management it
would be appropriate to retain that requirement on a temporary
basis only.
Committee accepted the suggestion by the
Licensing Authority that the wording in Conditions 1,7,10 and 11 be
changed to replace the word “Licensee” to
“Operator”.
DECISION
The decision of the Committee is as
follows:
To modify the conditions on the Licence which
they find to be a step that is appropriate for the promotion of the
Licensing Objectives.
To accept and replace the conditions on the
Licence with the Schedule of Conditions proposed by the Licensing
Authority/Trust Inns Limited and Northumbria Police save for the
amended wording referenced above in Conditions 1,7, 10 and 11.
Right of Appeal
There is a right of appeal against this
decision to Newcastle Magistrates Court. An appeal must be commenced within 21 days
beginning with the day on which you receive written notification of
the decision.
