Purpose

To enter into a Deed of variation of the existing combined Section 38 of the Highways Act 1980 and Section 33 of the Local Government (Miscellaneous Provisions) Act 1982 Agreement in connection with the former Carrick’s Bakery Site, Ponteland Road. This estate is now called Alnmouth Court. The variation is required to update the Highway Adoption drawing. These changes have been agreed and approved by the City Council.

Decision

The Assistant Director, Transport is recommended to:-

(i)  Authorise the Council to enter into a variation of the existing Section 38 Agreement based on the proposal set out in the report below, and

(ii)  Authorise the Assistant Director of Law and Governance to complete all the relevant legal documentation
