Title of Decison Requested: Legal action to
ensure compliance with Enforcement Notice at Higher Bidbrook,
Ringaton, West Anstey, EX36 3NX case ref 14101

Reasons for the decision

Decision requested by decision maker:
Agreement to prosecute through criminal proceedings for
non-compliance with an Enforcement Notice issued on 28 January 2025
at Higher Bidbrook, Ringaton, West Anstey, EX36 3NX. Furthermore,
following such action, agreement to pursue injunctive action
through additional court proceedings to secure compliance should
the owner still not comply with the Enforcement Notice.

An Enforcement Notice was issued on 28 January 2025 for the breach
that within the last 4 years, unauthorised operational development
consisting of the construction of a new building on the land. The
Notice took effect on 11 March 2025 and gave 3 months for
compliance (or by 11 June 2025). The steps on the Notice require:
“1. Remove building in the approximate location outlined in
blue from the land outlined in red on the attached plan; 2. Remove
from the land edged red any rubbish or debris resulting from
compliance with step 1.”

The Council consider that all other possible
remedies have been used but no resolution has been
reached.
