Reasons for the decision
1.1. The property has been unoccupied since
the owner was placed in a nursing home by Devon County Council
Adult Social Services in 2022
1.2. The condition of the house and its garden continues to
significantly adversely affect the amenity of the neighbours and
locality
1.3. A notice under s215 of the Town & Country Planning Act
1990 was issued on 11 April 2025 requiring steps to be taken to
improve the garden and house
1.4. The compliance period for works to the garden ended 16 June
2025 and the compliance period for works to the house ends 16
September 2025
1.5. The steps required by the s215 notice have not been complied
with
1.6. A quote has been received for the works to the garden
1.7. The ownership of the property is not currently registered with
HM Land Registry
Alternative options considered
3.1. A prosecution is not in the public
interest because the owner is vulnerable
3.2. Action to secure compliance with the garden clearance element
of the s215 notice is proportionate because its condition continues
to significantly adversely affect the amenity of the
locality.
