Title of Decison Requested: TPO Prosecution -
27 Magnolia Close, Barnstaple, EX32 8QH

Decision requested by decision maker: Agreement to prosecute
through criminal proceedings for unauthorised works to trees within
a Tree Preservation Order 336.

Reasons for the decision

On 27 February 2025 Arboricultural Officer
contacted Planning Enforcement officer to investigate tree work
undertaken at 27 and 28 Magnolia Close, Whiddon Valley,
Barnstaple.

On 28 February 2025 Planning Enforcement Officer visited site and
verified that a number of trees were topped on the other side of
the fence at both properties.

Alternative options considered

The Council has considered a tree replacement
notice, however with consideration to the degree of damage and the
owners position the trees are not protected the Council consider
prosecution is proportionate.
