Decision
Decision requested by decision maker: To undertake works in default of the steps required within the (s.4) notice issued under the Prevention of Damage by Pests Act 1949 in respect of Rock Avenue, Lynton
Reasons for the decision
The occupier has been unable to comply with the Prevention of Damage caused by Pests Act 1949 – Section 4 notice served 19th June 2025 to manage the pest infestation originating from her property due to overgrowth, which is posing risk to the public. There have been ongoing reports of rodents since 2021.
Alternative options considered
Prosecution not an appropriate action. It would not be in the public interest to prosecute, the occupier has stated their intention to remedy the situation, however has failed to do so in the agreed timescales.
Action to secure compliance with the notice is proportionate as there is ongoing issues with rodents from the property noted by neighbours dating back to 2021.
