Authorisation given to extend the completion
date of the Agreement under Section 278/38 of the Highways Act 1980
for the residential development at Bridgewater Road, Scunthorpe,
from 30 July 2023 to 30 July 2025 without amendment to the amount
of supporting bond.

Reasons for the decision

The completed S38 agreement support
development and permit the Council to adopt the roads, footways,
verges, swales, and highway drainage once the development has been
completed to the council’s requirements. The S38 agreement
can only legally last for two years and requires an extension of
time if works aren’t complete at the end of the two year
period. This development is not yet completed and the agreement
needs renewing.

Alternative options considered

Not to approve the extension of the completion
date of the S278/38 agreement for the residential development at
Bridgewater Road, Scunthorpe.
