DECISION

The Sub-Committee has heard from the applicant and the representations made by the police.

The Sub-Committee has considered whether the granting of the personal licence will be in the interests of the crime prevention objective.  It has considered the seriousness and relevance of the conviction together with any mitigating circumstances. 

A person holding a personal licence should be a person who is not only properly qualified but a person who will assist in the prevention of crime.

Granting a licence to a person with a relevant criminal record could undermine rather than promote, the crime prevention objective.

In line with the Council’s statement of licensing policy, on the balance of probabilities the licensing objective of the prevention of crime and disorder will not be safeguarded if the application were granted.

RESOLVED

On the basis that the applicant was convicted of a relevant offence on 4 December 2025, when he was disqualified from driving for a period of 12 months – sec 120(2) and Schedule 4 (as amended), the personal licence is refused.
