Purpose

Approval is sought to enter into the necessary contracts to
enable the school to become an Academy.

Decision

Cabinet resolved unanimously
to:

 

1.  Authorise the Council to enter into the
following: 

a.    
A Commercial Transfer Agreement
(CTA) between the Council, the Governing Body of Saint John Fisher
Catholic High School (the “school”) and St John the
Baptist Catholic Multi-Academy Trust (the
“Trust”); 

b.    
Deed(s) of Novation for the
Governing Body’s interest in the following contracts to be
novated from the Governing Body to the Trust: 

i.           
Solar Power Purchase Agreement
between the Council and the school dated 29 January
2015; 

ii.           
PV System Roof Access Agreement
between the Council and the school dated 29 January
2015; 

iii.           
Joint use Agreement between the
school, the Council and the Roman Catholic Diocese of East
Anglia. 

 

2.  Delegate authority to the Executive Director
for Children’s Services, in consultation with the Director
for Legal and Governance and the Executive Director for Corporate
Service to negotiate and enter into any documentation reasonably
required to facilitate the academy conversion of the
school.
