Purpose

The Cabinet Member: 

 

1.     
Approves the commissioning of social care placements for
adults and children by directly awarding contracts to the relevant
providers, without competition, and; 

 

2.     
Gives delegated authority: 

 

a) to the Executive Director for Adult Social Care and
Commissioning or their delegate (in the case of placements for
adults); and;  

b) to the Executive Director for Children's Services or their
delegate (in the case of placements for
children). 

 

to award the care placement contract, subject to number 3
below;  

 

3.     
Approve the award and enter into contracts for such care
placements, subject to the
following:  

I.           
Such care placements must be within the
budget;  

II.           
For above threshold placement contracts, it is a compliant
direct award in accordance with the Public Contract Regulations
2015 or Procurement Act 2023 (as amended or replaced from time to
time), or for placement contracts below threshold, by applying the
same principles to justify the direct award as if the placement was
an above threshold placement
contract;  

III.           
Each placement must be made in consultation with Legal
Services and the Head of Finance, to assess and comment upon the
financial implications and documented in an Officer’s
Decision Notice recording the exercise of this
delegation;  

IV.           
The Executive Director for Adult Social Care and
Commissioning (in the case of placements for adults) and the
Executive Director for Children’s Services (in the case of
placements for children) shall maintain an anonymised list of each
placement made in reliance upon this delegation (detailing, in
relation to each placement, the duration of the placement and value
(stated either in weekly, monthly or annual figures));
and 

V.           
Each placement must be documented in writing (by an
appropriate contract or individual placement agreement
documentation).
