Purpose

To support the emergency decision
taken on 21 July 2025 under the constitution at Part 4, Standing Orders
Section 4 – General Standing Orders, section 6.1 by the Chief Executive in
consultation with the Leader and the Chair of the relevant Scrutiny Committee
(Prevention, Independence & Resilience).

 

Decision

Cabinet resolved to support the
emergency decision taken on 21 July 2025 under the constitution at Part 4, Standing Orders
Section 4 – General Standing Orders, section 6.1 in which the
Chief Executive in consultation with the Leader and
the Chair
of the relevant Scrutiny Committee (Prevention, Independence
& Resilience), took the decisions
to: 

 

1.    
Authorise the Council to exercise
its right to terminate the contract between PCC and Nottingham
Rehab Limited for provision of Integrated Community Equipment
Services across Peterborough and Cambridgeshire with immediate
effect as a result of a contractual termination event being
triggered. 

 

2.    
Authorise the Council, as lead
commissioner on behalf of CCC and the ICB, to direct award a new
contract for the Integrated Community Equipment Service across
Peterborough and Cambridgeshire, to an alternative provider,
Medequip Assistive Technology Limited, to ensure continuity of this
statutory service at a maximum annual value of £8,758,947 per
annum and a total value of up to £35,035,788 over a 4 year
contract period. This value excludes annual fee rate changes which
will be agreed through the annual fee rate change business plan
investment case approval and internal governance. The new contract
may commence upon this report becoming
effective. 

 

3.    
Authorise a variation to the
Delegation Agreement that operates between PCC and CCC, which
underpins PCC's responsibilities as lead authority of this service,
to reflect any variation to the contractual and financial position
of new arrangements as a result of PCC exercising the right to
terminate the existing contract with Nottingham Rehab Limited and
enter into a new contract with Medequip Assistive Technology
Limited. 
These changes shall take effect
from the date of this report. 

 

4.    
Authorise a variation to the
Section 75 Partnering Agreement that operates between PCC, CCC and
the ICB in relation to Peterborough and Cambridgeshire’s
Integrated Community Equipment Service to reflect necessary changes
to the contractual and financial position of any new arrangements
PCC shall enter into. These changes shall take effect from the date
of this report. 

 

5.    
Acknowledge that both CCC and the
ICB, for whom PCC commissions the Integrated Community Equipment
Service on behalf of, have taken equivalent urgent decisions and
agree through their respective governance structures to support the
simultaneous termination and direct award of contract by PCC as the
lead authority.
