Purpose
CC and CPFT work together under a
Section 75 agreement, delegating Adult Social Care duties for
people with mental health needs to CPFT. This expired March
2024.
This decision concerns extending
the agreement to April 2026. This will ensure people with continue
to receive social care that is seamless with their clinical
support.
The total value of this extension
is £3,348,559:

- £1,707,568 to be paid for
2025/6
Decision
Cabinet RESOLVED to:
1. To note the operational
arrangements under which the section 75
functions have continued to be
delivered since 1 April 2025, and to
confirm and endorse the
continuation of the existing delegation
arrangements on a prospective
basis for the period from the date of this
decision to 31 March
2026
2. To approve the variation and
formalisation of the existing contractual
arrangements underpinning the
section 75 delegation, by entering into a
Deed of Variation to the implied
contract, such variation to take effect
from 1 April 2025 to 31 March 2026
for the purposes of contractual
regularisation and financial
accounting; and to approve the associated
expenditure of £1,707,658 to
fund the delivery of the delegated functions
during that period.
3. Authorise the inclusion of
details to formalise the role of the Short-Term
Adult Reablement Service (STARS)
within the Deed of Variation by which
the agreement will be
extended.
4. Note that a new agreement
between PCC and CPFT will be in place from
April 2026. Governance approval
for this is being sought via a separate
report, due to Cabinet in March
2026.
