Purpose
The decision enables the £30,000
Community Contribution to be spent by the Parish Council on local
priorities, within the definitions provided in the section 106
agreement.
Decision
Under the section 106 agreement for Welland
Farm (2019/0787/FUL), £30,000 was collected in accordance
with the Third Schedule of the development for the provision,
improvement, replacement, operation or maintenance of
infrastructure within the vicinity of the development or such other
measures that mitigate the impact of the Development on the local
area. The agreement provides Rutland County Council (RCC) with the
option of transferring this Community Contribution to Barrowden
Parish Council (BPC). The sum is approximately the same that would
have been the parish share for BPC had it been possible to issue
the site with a CIL Liability Notice. BPC has confirmed in writing
that it will comply with the clauses of the agreement and therefore
the contribution can be released to the BPC. Any part of the
contribution which remains uncommitted after 5 years must be
returned to RCC.
