The reasons are:The Weaste Lane/
Liverpool St Junction is a site of concern due to
the lack of appropriate pedestrian and cycling facilities. The
existing crossing facilities are uncontrolled and create
difficulties for pedestrians, particularly vulnerable user groups.
The existing junction also has no cycling facilities. The present
layout provides a significant pedestrian and cyclist barrier with
vulnerable road users discouraged from using this junction due to
its lack of safe crossing facilities.
 
The junction improvement scheme
aims to upgrade the existing traffic signals to introduce
controlled pedestrian crossing facilities to all arms of the
junction along with improved cycling facilities.
 
Options considered and rejected were:Doing nothing will not
solve the current or future problems with crossing provision.
Increasing the capacity of the junction while providing crossing
facilities (Do Medium and Do Maximum options) increases time delays
and adds cost with more works and service diversions.
 
The current proposal (Do
Minimum) provides for appropriate crossing facilities while
offering value for money.
 
Assessment of risk:Low: Similar junction
improvement projects have been successfully delivered previously.
There are no significant risks associated with the delivery of the
project.

Legal advice obtained:When commissioning
contracts for the procurement of goods, services or the execution
of works, the Council must comply with the public procurement
regulations and its own Contractual Standing Orders (CSO’s),
failing which a contract may be subject to legal challenge from an
aggrieved provider. CSO’s apply to every contract, including
temporary ones, for the procurement of supplies, services and the
execution of works undertaken by or on behalf of the Council,
subject to certain exceptions listed in the Orders. CSO’s
stipulate that where a suitable framework agreement exists, this
must be used unless there is an auditable reason not to.
 
In awarding the contract to
Rosgal Ltd using the call-off procedure under the Rochdale Highway
Services Framework Agreement, the Council will need to have
followed the procedure set out in the framework agreement for mini
competition to ensure the procurement process is compliant. Bids
were evaluated on the most economically advantageous tender basis
in line with published procedures. The procurement procedures
therefore appear robust and compliant with the requirements of the
Council’s CSO’s and public procurement
legislation.
 
The terms and conditions
established under the framework agreement govern the contracts let
under the framework although each contract will inevitably have
some differences to reflect the agreement struck between the
parties to the contract
 
Financial advice obtained:£913,166.26
allocated from the agreed Highways Capital Budget 2025/26 funded
by:
·     
CRSTS grant from the Department for Transport 24/25
- £213,166.26.
·     
CRSTS grant from the Department for Transport 23/24
– £700,000.00.
 
All spend should be closely
monitored to avoid complacency and wastage, further expenditure
scrutiny will be carried out at key points throughout the proposed
schedule.
 
This Scheme falls outside the
scope of Project Innovate.

Procurement advice obtained:This
project was a further competition under the STAR Procurement
– Rochdale Highways Related Framework, Lot 1
Civils.  It is compliant with standing
orders and PCR’s 2015.
 
HR advice obtained:Not

Climate change implications obtained:The scheme will support modal shift from private car to walking
and cycling. The primary objective of the scheme is to make walking
and cycling across the junction safer. More sustainable travel
choices will help to reduce transport related emissions.
