Salford City Council - Record of Decision
 
I, Councillor Mike McCusker, Lead Member for Planning, Transport & Sustainable
Development, in exercise of the powers contained within the Council
Constitution, do hereby
approve:
 
The
expenditure of £235,145.32 of Section 106 contributions
towards Salford Sports Village.
 
The reasons are: to meet the
requirement of the relevant Section 106 Agreement detailed within
the report.
 
Options considered and
rejected:Not applicable as the Section 106 Agreement detailed
within the report requires expenditure on specific individual
projects or types of projects.
 
Assessment of risk:
Low – Developers can seek
to legally challenge the city council to claim back Section 106
monies if not used on a scheme that mitigates the impacts of that
development and/or spent in line with the requirements of the
Section 106 agreement.
Low - In terms of the works, a
sum has been allocated against the main construction
risks.
 
The source of funding
is: Section 106 contributions of £235,145.32 which have
been received from the developments located at:
 

§ 
£31,897.32 from Oaklands Nursery (Section 106
Ref: 298 - 14/65545/FUL);

§ 
£183,248.00 from Agecroft Road (Section 106
Ref: 322 - 15/66785/FUL); and

§ 
£20,000.00 from Castle Irwell (Section 106
Ref: 405 - 18/71890/OUTEIA)

Section 106
contributions can only be expended in accordance with the terms of
the planning obligations outlined in the relevant Agreement. If the
Council cannot demonstrate that the contribution has been expended
in accordance with the agreements, there is a risk that the
contribution may need to be repaid to the developers. This report
explains why officers are of the view that the expenditure set out
herein would be in line with the terms of the Agreement.

The £235,145.32 Section
106 funding as identified in the report is towards Salford Sports
Village.  The funding will be used
towards resurfacing the one remaining all weather pitch yet to be
resurfaced, upgrade the CCTV system which captures use of the
pitches, internal works to upgrade the changing rooms, create a bag
store area and reconfiguration of the reception space. The funding
as identified in the report has been received and are available to
fund the works.

Climate change implications are
considered through the planning application process, and where
relevant appropriate mitigation will be identified through planning
conditions and/or planning obligations. The Section 106
contributions can only be used towards specific mitigation in
accordance with the respective Section 106 agreement. Environmental
considerations have been incorporated within the main body of the
report.
