The reasons are:
to enable the council to procure building works on a
competitive basis under a Minor Building Works Framework
Agreement
Options considered and rejected were:The retendering of the
frameworks to compile a new list of contractors. The existing
framework contract contains an option for an extension period of
one year. On the basis that the existing framework contractors have
demonstrated their ability to meet the Council's neds and
objectives it is considered reasonable to exercise the option to
extend the term. A contract extension would also allow the
continued delivery of social value outcomes in terms of continued
employment opportunities and use of local labour and
suppliers.
Assessment of risk: Medium. If the current
frameworks were allowed to expire it would require the Council to
use other national frameworks which may not be as advantageous in
terms of delivery of social value.
The source of funding is: Funding will be from a
range of sources to support any specific works or projects i.e.
capital programme, revenue allocations and external grant
support.

When commissioning
contracts for the provision of goods, services or the execution of
works, the Council must comply with the provisions of the Public
Contracts Regulations 2015 (PCR) and its own Contractual Standing
Orders (CSO’s) as set out in the Constitution, failing which
the award of a contract may be subject to legal
challenge.
In that regard, the
Framework Agreement was set up following a compliant tender process
in accordance with public procurement regulations in force at the
time and CSO’s by way of the opportunity for the existing
contract being appropriately advertised as an open competition
inviting interested companies to submit bids to be appointed to one
or both lots for a period of two years with a further option to
extend for a further two (2) periods of 12 months (a maximum of 4
years). The terms of the framework permit awards to contractors
either by direct award for work below £75,000 for Lot 1 only
and mini competition for both Lots around work valued from £0
to £750,000.
It is an established
principle that an existing public contract is capable of being
extended where the original agreement makes provision for the
extension, and CSO’s allow for contract extensions to be made
where the original contract makes provision for such an extension
of the original term. The purpose of a
framework agreement is to select through procurement/evaluation
process a number of providers who can meet the service requirements
of the Council, as and when those services are required.
When the Framework
Agreement was originally put out to tender, it was made clear that
the initial term would be subject to a potential extension of a
period of up to twenty four months (2 x 12 month periods), hence
any risk that any extension granted could be subject to realistic
challenge by an aggrieved provider, on the basis that it ought to
have been put out to tender and advertised in accordance with
public contract regulations and CSO’s, is extremely low, and
the option to extend within the agreement is now being properly
exercised.
The maximum term for
the framework agreement is a 4-year period (2 years plus the option
to extend for a further 24 months), and the terms and conditions
established under the framework govern the contracts let under it,
although each contract will inevitably have some differences to
reflect the agreement struck between the parties to the
contract. At the end of the 4-year
period, the framework must be dissolved and competition for the
goods or service re-opened, and a new framework can then be
established where appropriate. This ensures that value for money
can be periodically tested, and open competition
maintained. The period of the
individual contracts established under the framework can be as long
or as short as the authority requires and may be entered into at
any time during the period of the framework agreement.
Also, in accordance
with CSO’s, where provision is made within an existing
contract for an extension to the term, and the value is over
£150,000, approval should be sought from Procurement Board,
and if over £1million by the City Mayor on the recommendation
of Procurement Board.

There are no direct financial implications for the Council from
the awarding of places on the framework. However, it will provide
clear guidance to officers procuring these types of works and
ensure that best value is achieved.
The costs of any works carried out under the frameworks will be
funded from available resources within the Councils approved
capital and revenue programmes.

The opportunity for
the existing contract was advertised in the FTS replacement for the
European Journal, Contracts Finder and the Northwest Portal as an
open competition inviting interested companies to submit for one or
both lots for a period of two years with a further option to extend
for a further two (2) periods of 12 months (a maximum of 4
years).
The proposal to
exercise the option to extend the contract for a further period of
one year will allow us to continue providing clear guidance to
Council Officers regarding any procurement of capital and revenue
funded building projects vis the two encompassing Minor Building
Works Framework Agreements either by direct award for work below
£75,000 for Lot 1 only and mini competition for both Lots
around work valued from £0 to £750,000. This will
ensure that all such procurement activities are compliant,
therefore this complies with Contractual Standing
Orders.

Climate change implications obtained: Building Surveying and Facilities Management Team
All projects are developed to
meet or exceed current legislation and requirements relating to
energy efficiency and carbon reduction targets. Projects are
required to support the Council’s objectives of becoming
carbon neutral by 2038.
Sustainability plans would be
targeted to also be aligned with opportunities to deliver social
value outcomes.
