Regeneration, in exercise of the powers contained within the City
Council Constitution and ion
consultation with Cabinet, do hereby:
1.
Approve the waiver of the pre-commencement
conditions for the Regent Trading Estate - Affordable Housing
Scheme
2. Approve the
revised funding mix for the scheme.
3.
Delegate authority to the Executive Director of
Place in consultation with the S151 officer to negotiate, agree,
and finalise the detailed terms of the transaction.
4.
Authorise the Shared Legal Service, or externally
appointed solicitors, to prepare all necessary documentation and to
take all steps which are required to give effect to the above
recommendations.
The
Reasons are to maintain the
current delivery programme and protect the agreed contract price
with the main build contractor:

Why is exemption from call-in required –
please provide advice as to how any delay will seriously prejudice
the legal or financial position of the Council
Add the reasons for
the request to waiver call-in.
In order to maintain the agreed contract sum
and ensure the delivery of the scheme commences on programme in
March 2026 approval is being sought to waive a number of
pre-contract conditions within the Development Funding
Agreement.
An urgent decision is required as the
construction sum can only be held until the 13th
March.
Failure to secure urgent approval to the
pre-condition waivers will result in significant programme delays and the need to re-tender a
number of construction packages. Due to
ongoing market inflation forecasts indicate that build costs could increase by a further
£850k, a scenario that would render this much needed
affordable housing scheme undeliverable.
