City Council - Record of Decision
I, Councillor Mike McCusker,
Lead Member for Planning, Transport and Sustainable Development,
in exercise of the powers contained within the
Council Constitution, do
hereby:
I.
Note that a fully updated Statement of Community Involvement (SCI)
has been prepared; and
II.
Approve a period of public consultation on the fully updated SCI
lasting for a period of 6 weeks and starting no earlier than
Thursday 22 February 2024.
The
Reasons arethat a full update to the SCI is necessary to reflect
current legislative requirements and the most up to date national
policy and guidance relating to involving communities and other
stakeholders in the planning processes of plan making and decision
taking. The updated SCI also includes a new section on
Neighbourhood planning, reflects the increasing digitisation of the
planning service and also more accurately reflects the operation of
the Planning and Transportation Regulatory Panel (including site
visits, frequency of meetings and the submission of representations
in the run up to meetings).
Whilst there is no statutory
requirement to consult on any updates to the SCI it is considered
appropriate to do so in the interest of inclusivity and fairness
and it is also considered appropriate that this consultation period
should be for a period of 6 weeks.
Assessment of risk is low.
The updated SCI will
ensure that guidance relating to involving communities and other
stakeholders in the different planning processes (plan making and
decision taking) is up to date and takes into account changes that
have taken place since the adoption of the SCI in 2010 (and the
2020 adopted SCI that represented only a partial update to the 2010
document).
The
source of funding for the consultation
and associated printing and postage
will be met from existing
revenue budgets.

In preparing and updating the
SCI the council must have due regard to the legislative provisions
contained in the Planning and Compulsory Purchase Act 2004, the
Town and Country Planning (Local Planning) (England) Regulations
2012 and the Localism Act 2011, in addition to the National
Planning Practice Guidance: Plan-making.
The council is required to
review their SCI every 5 years from the date of adoption and it is
of paramount importance that the SCI is updated given that part 1
of the Local Plan was adopted in January 2023 and the council is
now progressing work on part 2 of the local plan.
Even though there is no
statutory requirement to consult when reviewing and updating the
SCI, it is considered to be a comprehensive, equitable and robust
approach to do so, which would reduce the potential for any legal
challenge.

There will be minimal costs
associated with the consultation. These will include printing and
postage, for which an existing revenue budget exists. Increasing
digitisation of the service will further enable communication with
stakeholders without incurring extra cost.
