I, Councillor McCusker, Lead Member for Planning, Transport and Sustainable
Development, in exercise of the powers contained within the Council
Constitution do
hereby:
 
Authorise the making of the Traffic Regulation Order
below, in the original form, as advertised and set out in the
report:
 

City Of Salford
(Maplewood Court, Rigby Street, Kersal
& Broughton Park, Salford) (Prohibition of Waiting) Order
2023
 
The
Reasons are:
That
the necessary action be taken under the Road Traffic Regulation Act
1984 to advertise the intention to make the Traffic Orders to
introduce ‘City of Salford (Maplewood Court, Rigby Street,
Kersal & Broughton Park, Salford)
(Prohibition of Waiting) Order 2023’ to create safer
environment for all road users.
 
Options considered and rejected were:
No other options were
considered.
 
Assessment of Risk:
The restrictions will be signed
in accordance with the Traffic Signs Manual and Traffic Sign
Regulations and General Directions. (TSRGD 2016).
 
The
source of funding is:
The scheme is funded from
Highways Devolved Capital Budget for East Salford in 2023-2024
financial year.
 
Legal
Advice obtained:
The Council, by virtue of the
Road Traffic Regulation Act 1984 can introduce orders to manage
traffic. Where Traffic Regulation Orders are required, they should
not give rise to any particular legal
implications provided the works and procedures are carried out in
accordance with the relevant statutory requirements, which would
include the consideration of any objections to a proposed
TRO.

The proposed scheme will be
funded from Highways Devolved Capital Budget for East Salford in
2023-2024 financial year.
