I,
Councillor Mike McCusker, Lead Member for Planning, Transport and
Sustainable Development, in exercise of the powers contained within
the Council Constitution, do hereby:
Authorise
the making of the Traffic Regulation Order below, in the modified
form, as set out in the report:
City of Salford (Hilton Lane Area – Walkden
South)
(Prohibition of Waiting and 20mph Speed Limit
Amendment) Order 2023
The reasons
are:
That the necessary action be taken under the Road Traffic
Regulation Act 1984 to advertise the intention to make the Traffic
Order to introduce: City of Salford (Hilton Lane area – Walkden
South) (Prohibition of waiting and 20mph speed limit amendment)
order 2023 as a permanent Traffic
Order.
Options considered
and rejected were: To implement the
original order. Two objections were
received to the original proposals relating
to the waiting restrictions around the emergency access route,
stating that the restriction unduly restricts the junction of
Cosgrove Close and outside one property on Avoncliffe Road.
The objections were considered,
and we feel that the restrictions could be removed from the
junction of Cosgrove Close without unduly impacting highway safety.
With regards to restrictions on Avoncliffe Road the restrictions are already at a
minimum and could not be reduced without risking the emergency exit
route being obstructed.
Assessment of risk: The proposed NWAAT restrictions
are appropriate to help ensure visibility sight lines are
maintained not just for vehicles but cyclists and pedestrians
crossing at junctions mention and also to ensure the emergency can
be used should it be required at any time.
The source of funding
is: The scheme is being funded by the developers.
Legal advice
obtained: The
Council, by virtue of the Road Traffic Regulation Act 1984 can
introduce orders to manage traffic. Where Traffic Regulation Orders
are required, they should not give rise to any particular legal
implications provided the works and procedures are carried out in
accordance with the relevant statutory requirements, which would
include the consideration of any objections to a proposed
TRO.
