I, Councillor Barbara Bentham, Lead Member for Environment, Neighbourhoods, Sports
& Leisure, in exercise of the powers contained within the
Council Constitution, do
hereby:
 
Authorise the making of the Traffic Regulation Order below,
in the modified form, as set out in the report:
 

City of Salford
(Preston Avenue and Preston Close, Eccles) (Prohibition of Waiting)
Order 2023
 
The
reasons are:
That the necessary action be
taken under the Road Traffic Regulation Act 1984 to advertise the
intention to make the Traffic Orders to introduce ‘City of
Salford (Preston Avenue and Preston Close, Eccles) (Prohibition of
Waiting) Order 2023’ to create safer environment for all
road users.
 
Options considered and rejected were:
To take forward the original
scheme as advertised. This was rejected and the amended scheme
proposed which reflects a compromise between the demand for
on-street parking in the area, whilst still maintaining access for
all road users, as set out in the report.
 
Assessment of risk:
The restrictions will be signed
in accordance with the Traffic Signs Manual and Traffic Sign
Regulations and General Directions. (TSRGD 2016).

source of funding is:
The scheme is funded from
Highways Devolved Capital Budget for Eccles in 2023-2024 financial
year.
 
Legal
advice obtained:
The Council, by virtue of the
Road Traffic Regulation Act 1984 can introduce orders to manage
traffic. Where Traffic Regulation Orders are required, they should
not give rise to any particular legal
implications provided the works and procedures are carried out in
accordance with the relevant statutory requirements, which would
include the consideration of any objections to a proposed
TRO.

The proposed scheme will be
funded from Highways Devolved Capital Budget for Eccles in
2023-2024 financial year.
