The Reasons are:
The Mosley Common Road/A580
Junction is a site of concern due to the lack of appropriate
pedestrian and cycling facilities and additional pressure will be
placed on an already busy location from significant housing
developments on the Wigan side of the local authority boundary on
which the junction lies.
 
The junction improvement scheme
aims to upgrade the existing traffic signals to include Toucan
Crossings, suitable for cyclists and pedestrians on the North,
South and West arms of the junction and pedestrian crossings on the
East arm of the junction. Hazard warning and tactile paving will be
upgraded along with carriageway and footway resurfacing
works. 
 
Options considered and rejected
were:
Doing nothing will not solve
the current or future problems with crossing provision. Increasing
the capacity of the junction while providing crossing facilities
increases time delays and adds cost with land purchases required as
well as considerable service diversions.
 
The current
proposal, arrived at after extensive
feasibility and preliminary design exercises provides for
appropriate crossing facilities while allowing for future
improvements to capacity by Wigan MBC on the North arm of the
junction which will be the arm impacted by the housing
developments.
 
Assessment of Risk:
Detailed designs have been
drawn up for the project and the submitted tender price reflects
this.
 
There is funding allocated for
this work in the current approved Capital Programme.

Legal Advice obtained:
When commissioning contracts
for the procurement of goods, services, or the execution of works,
the Council must comply with the Public Contracts Regulations 2015
(PCR) and its own Contractual Standing Orders (CSO’s),
failing which a contract may be subject to legal challenge from an
aggrieved provider. The proposed award of the contract follows a
tender exercise by mini competition in accordance with the
STaR Highways Framework Agreement as
approved by Procurement Board in May 2023.
 
The Council will need to have
followed the procedure set out in the framework agreement for mini
competition to ensure the procurement process is compliant. Two
tenders were received from framework suppliers for this project,
which have been evaluated on the most economically advantageous
tender basis in line with published procedures resulting in the
proposed award of the contract to Eric Wright Civil Engineering
Ltd.
 
For the target costs provided
by technical services for professional fees there are no Legal
implications as such. The work will be carried out and delivered by
the Council's internal resources.
 
The appointment of TfGM for UTC
and signal installation is made in accordance with the provisions
in the GMCA constitution which delegates duties for managing
traffic/traffic signals/ infrastructure etc to TfGM on behalf of
the districts. Also in view of TfGM’s previous involvement in
carrying out work and services for the Council such as UTC’s,
design and feasibility studies, any risk of challenge would be
extremely low, particularly bearing in mind the value of the
appointment, and the benefit to the Council and value for money
involved greatly outweighs any risk (which is minimal in any
event).
 
The procurement procedures
therefore appear robust and compliant with the requirements of the
Council’s CSO’s and PCR.

The remainder is historic CRSTS
grant sitting on the place balance sheet. This will be brought into
the programme when needed. Expenditure Code: D00268.

This contract was tendered as a
mini competition under the STAR Highways Framework, Lot
7.  There were 2 submissions and Eric
Wright Civil Engineering Ltd submitted the most economically
advantageous tender. This is a compliant route to market in line
with SCC standing orders and PCR’s 2015.

Climate Change Implications
obtained:
The scheme will support model
shift from private car to walking and cycling. One of the
scheme’s central objectives is to make walking and cycling
across the junction safer. More sustainable travel choices will
help to reduce transport related emissions. The introduction of
green infrastructure will also support the reduction of greenhouse
gases and more sustainable drainage.
