Council Constitution
do hereby approve:
 
·     
an exception to Contractual Standing Orders, as
permitted within the City Council Constitution, for the reason(s)
highlighted in the table below and the award of the Contract for
Approval for the Greater Manchester Sexual Health Improvement
Programme (GMSHIP) (PaSH programme) MOU and contract to be held by
Manchester City Council, who will become the lead commissioner and
agree Salford’s funding contribution to the GM programme, as

The reasons are:
The commissioning of the
collaborative GMSHIP has been led by Salford since it was first
procured in 2017. Prior to this arrangement each Local Authority
had individual contracts with George House Trust, BHA for Equality
and the LGBT Foundation. These three organisations joined
together to deliver the contract in a consortium lead by BHA known
as PaSH. The jointly commissioned approach has been successful in
developing a coordinated approach across GM with the three partners
working together effectively to deliver a programme of support and
prevention activities. PaSH has also been the vehicle to deliver
much of the GM HIVe project to eliminate new transmissions of HIV
and central to the GM Fast Track Cities work.
 
With the current
contract coming to an end there was an opportunity to change the
commissioning lead responsibilities. As Salford led on these
arrangements for seven years, managing the associated MOU, contract
monitoring and management, it was fair that this should pass
on to another LA to take the lead.  Manchester is the lead
funder of this contract providing 52% of the contract value and
agreed to take the lead responsibility for the next phase of
commissioning this area of work.
 
Manchester City Council is
working on developing a contract/MOU and Key Performance Indicators
with effect from the 1st July 2024 to be
agreed by the other 9 GM Local Authorities for a
direct award for 3 years with the option for a 2 year extension
period.
 
Options considered and rejected were:
Salford continue as lead
commissioner or any of the other 8 local authorities who are part
of the GMSHIP act as lead commissioner.
 
Assessment of risk:
The risks of not
providing the GMSHIP programme include:
1. 
An increase in the number of people with STI’s
and HIV and the associated harms to health, testing and treatment
costs and for HIV lifetime costs. Many of these costs fall to
Salford City Council.
2. 
Without this programme there would be little support
for people who are living with HIV. This support is wide ranging
and includes encouraging medication adherence which makes HIV non
transmissible, so it can’t be passed on to other
people.
3. 
Fewer people who are at a high risk of acquiring HIV
will be aware of and taking Pre Exposure Prophylaxis (PrEP), which
prevents HIV transmission, putting them at risk of becoming a
person living with HIV and potentially passing it on to other
people.

Shared Legal Servies has provided (and will continue to provide)
legal support to Council officers with regards to the
recommendations set out in this report. This includes advice around
the necessary steps regarding the handover of the current contract
with BHA for Equality to Manchester City Council (MCC). In
particular to ensure that Salford City Council is satisfied that
MCC’s proposed procurement strategy (namely that they
re-commission BHA for Equality to continue delivery of the services
described in this report without further competition) is compliant
with the applicable procurement legislation.
 
Salford City Council’s contractual standing orders (CSOs)
para 9.11 states that in order to secure value for money, the
Council may enter into collaborative arrangements with other local
authorities and if this is compliant with the PCR as well as the
internal contract procedure rules of the leading organisation, then
it will be deemed to comply with Salford City Council’s CSOs
(subject to advice being obtained from procurement and legal).
Assurance has been provided by MCC with regards to their
procurement approach and they have obtained their own internal
approval to proceed on the basis of regulation 32 of Public
Contract Regulations 2015 (competition is absent for technical
reasons).
 
The
existing contract between SCC and BHA for Equality will
automatically expire at the end of its term.
 
It
is understood that the MOU to be proposed by Manchester City
Council shall substantially be in the form Salford City Council
used in the current arrangement (save that MCC will now be the lead
party). Shared Legal Services is happy to support the Council with
the finalisation of the MOU.

The purpose of this report is
to request approval for the GMSHIP (PaSH) MOU and contract to be
held by Manchester City Council, who will become the lead
commissioner, where previously this has been held by Salford City
Council.
 
The level of Salford’s
contribution is not affected and the budget is available from the
Public Health Grant.

The provision for
collaborative arrangements led by other public bodies, where this
would secure best value for money, are provided for with the
Contractual Standing orders
It is understood that
Manchester City Council (MCC) have undertaken to establish a
contract with the incumbent service provider in compliance with the
prevailing procurement legislation and their own contractual
standing order, and that it is anticipated that a memorandum of
understanding will be agreed between MCC and collaborative partners
including the Salford City Council to formalise the
arrangement.  Procurement will be happy
to provide any ongoing advice and/or support as
required.

As mentioned in the body of the
report this would allow for opportunity for SCC staff to further
add value to the work of Public Health. 
The main HR implications with this tender sit with the contract
provision and should this change potential TUPE implications for
those working on the contract.  This
assessment would, following the change in contract
‘owner’ would need to be assessed by Manchester CC at
the point of any change in this.
