The Reasons are;
The purpose of this
report is to seek approval for the award of the Highways Surface
Treatment contracts for the 2024/25 Capital Highways Investment
Budget.
 
Options considered and rejected
were:
The only alternative option to
contracting is to deliver the surface treatment works in-house.
Unfortunately, this would require
extremely specialist equipment, trained operatives and
surface treatment design experts.  
 
Assessment of Risk:
There is a risk in a
delay of, or not awarding, the 24/25 contracts for surface
treatment. This specialised service is high in demand, and we need
to book time with the contractor during the summer months. If we
are unable to carry out surface treatment, the poor condition of
the roads identified will need to be addressed using alternative
methods that are much more expensive and disruptive such as
resurfacing. The other option for many roads in the city is to
apply temporary patching which negatively impacts the local
community and simply pushes the problem further into an uncertain
future.

When
commissioning contracts for the procurement of goods, services, or
the execution of works, the Council must comply with the Public
Contracts Regulations 2015 (PCR) and its own Contractual Standing
Orders (CSO’s), failing which a contract may be subject to
legal challenge from an aggrieved provider. CSO’s state that
a framework arrangement should be used unless there is an auditable
reason not to do so.
 
The
proposed award of the contract was undertaken in accordance with
the STaR Highways Services Framework,
and the Council will need to have followed the procedure set out in
the Framework Agreement to ensure the award is compliant,
and bids were evaluated in accordance with published
criteria. In this instance submissions were
evaluated on the most economically advantageous tender basis in
line with the published criteria resulting in the proposed award of
the contract to General utilities Northwest Ltd. The procurement
procedures therefore appear robust and compliant with the
requirements of the Council’s CSO’s and public
procurement legislation.

Financial Advice
obtained:
This is an essential contract in
order for highways to provide a complete programme. This order is
within the previously agreed Highways Capital
budget 2024/25. However, all spend should be closely monitored and
any savings or efficiencies should be pursued where possible. This
falls out of scope of project innovate.
