The Reasons are:
Salford City Council (SCC) are working with the GMCA on a
programme called the Go Neutral Smart Energy programme. The
programme aims to deliver smart energy systems that will deliver an
impact against the city regions carbon neutral 2038 target, build
on the local economy and make energy supply more affordable. The
scheme aims to accelerate the delivery of up to 85MW of solar power
generated with battery storage and electric vehicle charging
infrastructure across GM. The programme is a key part of GMs work
to decarbonise its public estate. Key to achieving this target is
increasing investment in local, smart energy
infrastructure.? 
 
SCC is seeking to install solar PV at up to 9 sites across the
city as part of its contribution towards Greater Manchester’s
target of becoming a carbon-neutral city region by 2038 and towards
the 85MW solar generated power target above. This project would see
over 0.5MW of renewable energy generation added to the estate as
well as reducing SCC’s carbon emissions by over 88 tCO2e
saved per annum. 
 
Options considered and rejected
were:
None the proposed measures at each site
will contribute towards Salford and Greater Manchester’s
target of becoming a carbon-neutral city region by
2038.  
 
Assessment of Risk:
The programme will have a risk register in place and mitigation
measures. 
 
The programme is low risk as the roof and structural surveys
that are to be undertaken will de-risk the sites by identifying
whether they are able to proceed as planned and highlight any site
constraints.?? 

If we do not take this approach the risk is that we will delay
the installation of additional renewable energy assets and
associated budget and carbon savings for the council.?

Legal Advice obtained from Tony Hatton:
When commissioning contracts for the procurement of goods,
services or the execution of works associated with the project, the
Council as a ‘contracting authority’ must comply with
the Public Contracts Regulations 2015 (PCR) as well as the
provisions of its own Contractual Standing Orders (CSO’s),
Financial Regulations and the duties of Best and Social value or be
at risk of challenge from an aggrieved
provider.  
 
The report sets out that the Council proposes to award the
contract to NPS Energy Limited to complete the design and build of
roof mounted solar PV on up to nine SCC estate and Salford
Community Leisure sites, following a procurement exercise using the
GMCA’s Go Neutral Smart Energy Framework Lot 1 via the Chest
portal from which 3 submitted bids and were evaluated on a MEAT
(most economically advantageous tender) basis. 
 
The opportunity appears to have been advertised in accordance
with CSO’s and PCR, with the added benefit that undertaking
the tender exercise in this way will give some comfort to the
Council in ensuring that value for money is being obtained and
tested, with open competition maintained. The carrying out of a
compliant procurement exercise will ensure that the risk of
challenge to the final award of the contract to the selected
contractor is minimal and that any challenge, should it
materialise, is unlikely to be successful. 
 
If it hasn’t done so already, the Council will need to
investigate and secure all necessary and appropriate rights and
permissions (including, where appropriate, acquisition of land) to
enable them to access, construct, retain and operate the sites and
avoid delays.

The procurement board report is requesting approval to
award contract for roof and
structural surveys, design and installation of roof mounted solar
PV on estate and Salford Community Leisure
buildings.   
 
Tender and supporting documentation were advertised and live for
five weeks. Following the Tender process NPS Energy Limited had the
highest overall score with 81.62%. 
 
There is provision from Invest to save totalling £1.00m
within Planning Policy and Climate Change in the Place Capital
Programme for 2024/25. Once surveys are completed a review of the
associated costs and budget will take place to inform which sites
go forward to build. 
 
Procurement Advice obtained

The project was procured under the GMCA’s Go Neutral Smart
Energy Framework Lot 1 which is compliant with CPR’s 2015 and
SCC standing orders. Of the 3 bids submitted NPS Energy
Limited were the most economically advantageous tender when
taking into account the quality, price
and Social Value offer.

The GM 5 Year Environment Plan
commits GM to increasing local renewable energy generation and
councils need to be at the forefront of this work. The installation
of roof mounted Solar Farm installation supports this objective as
well as reducing electricity costs for the council and carbon
emissions as a result.?
