The Reasons are:
We are seeking to appoint a
Highways Drainage service provider under the current Technical and
Highways Framework to deliver essential reactive and planned
drainage maintenance works for the Technical Highways Services
team.
Options considered and rejected
were:
The only alternative option to
contracting is to deliver the drainage works in-house, this would
require specialist equipment and trained operatives and is not
currently or has been previously the delivery model of the
highway’s depot.
Assessment of Risk:
There is a high risk in a delay
of, or not, awarding this contract as any significant delay would
impact on the team’s ability to deliver business as usual
activity and respond to any emergency flooding or highway
collapses.

When
commissioning contracts for the procurement of goods, services, or
the execution of works, the Council must comply with the Public
Contracts Regulations 2015 (PCR) and its own Contractual Standing
Orders (CSO’s), failing which a contract may be subject to
legal challenge from an aggrieved provider.
CSO’s stipulate that where a suitable framework exists,
this must be used unless there is an auditable reason not to do so. The proposed award of the contract follows
a call off exercise in accordance with the Council’s
Technical and Highways Minor Civils Works Framework
(Drainage Lot) referred to in the body of the
report.
The
Council will need to have followed the procedure set out in the
framework agreement to ensure the procurement process is compliant
and bids were evaluated in accordance with published
criteria. In this instance submissions were
evaluated on the most economically advantageous tender basis in
line with the published criteria resulting in the proposed award of
the contract to General utilities Northwest Ltd. The procurement
procedures therefore appear robust and compliant with the
requirements of the Council’s CSO’s and public
procurement legislation.
Legal Services will assist with preparing any contractual
documentation upon receipt of instructions to ensure the
Council’s position and interests are protected.
Financial Advice

This is an essential contract in
order for highways to provide a complete programme. This order is
within the previously agreed Highways Capital
budget 2024/25 – £375,000.
There is also a
revenue element of the above contract to be considered, there is
sufficient budget (£210,000) that is split between various
highways cost centres within the planning and transport
budget.
However, all spend
should be closely monitored and any savings or efficiencies should
be pursued where possible. This falls out of scope of project
innovate.
