City Council - Record of Decision
 
I,
Councillor McCusker, Lead Member for Planning, Transport and
Sustainable Development, in exercise of the powers contained within
the Council Constitution, do hereby:
 
Authorise
the permanent making of the Traffic Regulation Order in the form
given in the Notice of Proposals as set out in the
report:

(Prohibition of
waiting, Limited waiting) And (goods only Loading bay) Order
2024
 
The reasons are: That the necessary
action be taken under the Road Traffic Regulation Act 1984 to
advertise the intention to make the Traffic Order to introduce
City of Salford
(Fairbrother Street, the quays ) (Prohibition of waiting, Limited
waiting)  and (goods only Loading bay)
Order 2024 as a permanent Traffic Order.
 
Implementation of the Traffic Order would allow enforcement of
waiting restrictions, limited waiting bay and loading bays, should
it be required, which are required to maintain access into and out
of Fairbrother Street, both for the new development on the
southside of the street and also the existing commercial businesses
on the north side of the street, which frequently require HGV
access.
 
It is also
required that there is a turnover of parking in the limited waiting
bay, that would benefit all residents, unlimited parking would only
benefit a few residents and limit option of all the other
residents.
 
Keeping
clear the loading bays for service vehicles, will ensure the new
development can be appropriately serviced without disruption and
waste collections being missed, which in turn may lead to other
issues of litter and unsanitary materials being left on the
highway.  
 
Options
considered and rejected were: Officers
suggest that the scheme be progressed as originally
advertised.
 
Assessment of risk: The restrictions
will be signed in accordance with the Traffic Signs Manual and
Traffic Sign Regulations and General Directions (TSRGD
2016).
 
The source of funding:
Developer
 
Legal advice obtained: The Council, by
virtue of the Road Traffic Regulation Act 1984, can introduce
orders to manage traffic. Where Traffic Regulation Orders are
required, they should not give rise to any particular legal
implications provided the works and procedures are carried out in
accordance with the relevant statutory requirements, which would
include the consideration of any objections to a proposed Traffic
Regulation Order.
 
Financial advice obtained: The scheme
is being funded by the developer.
 
Procurement advice obtained: There are
no procurement implications contained within this
report.
