to rescind the contract award for Street Lighting
High Mast Maintenance approved on 14 February 2024.

 
The Reasons are to continue essential maintenance of
vital Salford City Council assets and to ensure optimum operational
performance.
 
Options considered and
rejected were:
The use of external framework agreements.
 
Assessment of Risk: Medium: If this project does not go out to tender there is a risk that
the High Mast Lighting Columns could deteriorate, resulting in
possible structural or mechanical failure, and/ or loss of lighting
on key routes. This could potentially lead to masts requiring full
replacement or major remedial work at a significant cost to the
Council.
 
The source of funding
is: Programme funded from reserves secured from the capital
settlement from UV for streetlighting.

When
commissioning contracts for the procurement of goods, services, or
the execution of works, the Council must comply with the Public
Contracts Regulations 2015 (PCR) and its own Contractual Standing
Orders (CSO’s), failing which a contract may be subject to
legal challenge from an aggrieved provider.
 
CSO’s stipulate that where a suitable framework exists,
this must be used unless there is an auditable reason not to do so. The proposed award of the contract follows
a call off exercise in accordance with the Council’s
Technical and Highways Works Framework (Structures
and Bridges Lot) referred to in the body of
the report.
 
The
Council will need to have followed the procedure set out in the
framework agreement to ensure the procurement process is compliant
and the bid was evaluated in accordance with published
criteria. In this instance the sole
submission was evaluated on the most economically advantageous
tender basis in line with the published criteria resulting in the
proposed award of the contract to Coating Services Ltd. The
procurement procedures therefore appear robust and compliant with
the requirements of the Council’s CSO’s and public
procurement legislation.
 
Legal Services will assist with preparing any contractual
documentation upon receipt of instructions to ensure the
Council’s position and interests are protected.

This contract
opportunity was procured in compliance with Salford City
Council’s contractual standing orders and PCRs (2015) and was
a further competition through the existing Technical and Highways
framework (Lot 4 Structures and Bridges).
 
As part of the
Council’s Innovate programme and budget challenges over the
next three years, the service group should consider efficiencies,
revenue savings opportunities and enhanced contract management
KPI’s as part of this contract.
