Appointing to the re-tendered
LOT 3 will increase options for statutory homeless supported
temporary accommodation placements, with options now being
available in the west of the City.
Assessment of Risk: Medium.

When
commissioning contracts for the procurement of goods, services or
the execution of works the Council as a ‘contracting
authority’ must comply with the Public Contract Regulations
2015 (PCR) as well as the provisions of its own Contractual
Standing Orders (CSO’s), Financial Regulations and the duties
of Best and Social value, failing which the award of a contract may
be subject to legal challenge.
The
report sets out that the Council proposes to award the contract
for Commissioned
Statutory Homeless Supported Temporary Accommodation
Service following a compliant procurement
process using the open tender procedure. Having undertaken the
tender exercise in this way will give some comfort to the Council
in ensuring that value for money is being obtained and tested, with
open competition maintained. The carrying out of a compliant
procurement exercise will ensure that the risk of challenge to the
award of the contract to Salvation Army Homes is minimal and that
any challenge, should it materialise, is unlikely to be
successful.

The
LOT 3 scheme is financially viable and is cost effective spend,
providing it's used for statutory placements as this would mean no
subsidy loss due to the full rent being claimed back from DWP. In
the event this provision was unavailable it is likely that these
service users would end up in accommodation that would lead to
subsidy loss. Salvation Army will collect the rent and take the
risk of non-collection.
Contract to be funded through SCC general fund
revenue.
Lot
1 and 2 contracts currently run until 30th November 2026
with an option for a 2-year extension to 30th November
2028. If extended this would run in-line with LOT 3.

The
opportunity was advertised as an open tender on The Chest, inviting
companies to express an interest. A
fully compliant procurement process was followed in line with the
council’s contractual standing orders. As outlined in the
above report the successful tenderer met the minimum quality
standards and within budget. The procurement team are happy to
support the approval of the contract to The Salvation
Army.
The
TOMS’s Social Value outcomes identified during the tender
process will be contractualised and managed by the lead
Commissioner and Provider.
