City Council - Record of Decision
I,
Councillor Mike McCusker, Lead Member for Planning, Transport and
Sustainable Development, in exercise of the powers contained within
the Council Constitution, do hereby:
Approve the
modifications to the scheme, as set out in the report, and
authorise the making of the Traffic Regulation Order below in the
modified form.
City of Salford (Blackleach Drive, Walkden) (Prohibition Of Waiting
Restrictions) Order 2024
The Reasons are: That the necessary
action be taken under the Road Traffic Regulation Act 1984 to
advertise the intention to make the Traffic Order to introduce
City of Salford (Blackleach
drive, Walkden) (prohibition of waiting Restrictions) Order
2024as a permanent Traffic Order.
Implementation of the Traffic Order would allow enforcement of
waiting restrictions, should it be
required. Which are required to maintain safe access into and out
of the Blackleach Drive estate without
the risk of rear end shunts and where there is sufficient
visibility for drivers and pedestrians at the junction with Worsley
Road North.
Options
considered and rejected were: There are
no other options to consider, waiting restrictions are the only
option that can ensure sight lines and safe access can be
maintained and enforcement can be carried out should it be
necessary.
It is
recommended that the scheme be implemented as amended, from the
originally advertised proposals following objections, to a reduced
length of 8m.
Assessment of Risk: The restrictions
will be implemented in accordance with the Traffic Signs Manual and
Traffic Sign Regulations and General Directions (TSRGD
2016).
The source of
funding: Little Hulton & Walkden,
Capital Highways Devolved Budget for 2023 / 2024.
Legal
Advice obtained:
The Council, by virtue of the
Road Traffic Regulation Act 1984 can introduce orders to manage
traffic. Where Traffic Regulation Orders are required, they should
not give rise to any particular legal implications provided the
works and procedures are carried out in accordance with the
relevant statutory requirements, which would include the
consideration of any objections to a proposed Traffic Regulation
Order.
